Terms of service

Please read these terms carefully before using our service.

Introduction

These terms of service ("Terms") govern your access to and use of Freebird, a UX audit tool operated by Design Owls ("we," "our," or "us"). By using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

Acceptance of terms

By creating an account, accessing our website, or using our Chrome extension, you acknowledge that you have read, understood, and agree to be bound by these Terms and our privacy policy. These Terms apply to all users of our services, including visitors, registered users, and premium subscribers.

Description of service

Freebird is a UX audit tool that allows you to:

  • Create and manage projects for reviewing websites
  • Create three types of annotations: Issues (UX problems with severity levels), Strengths (positive feedback), and Bugs (technical issues with expected/actual results)
  • Automatically capture screenshots with each annotation
  • Attach files to annotations (up to 3 files per annotation, JPEG/PNG images only, maximum 5MB per file)
  • Receive automated design issue suggestions through Smart Fill (local analysis, no external AI services)
  • Export annotations in multiple formats: PDF reports, Markdown, and CSV
  • Synchronise data across devices (requires account)
  • Share projects via shareable links as interactive audit results (full feature access for recipients)
  • Use trial mode without an account (data stored locally only)

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice.

Trial mode

You may use Freebird in trial mode without creating an account. Trial mode provides limited functionality: data is stored locally on your device and is not synchronised across devices. Trial mode data is not accessible to us and will be permanently deleted if you uninstall the extension without migrating to an account.

To access full features including cloud sync, PDF downloads, and cross-device access, you must create an account.

User accounts and registration

To access certain features, you may need to create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your account information as necessary
  • Maintain the security of your account credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorised use of your account

You are responsible for maintaining the confidentiality of your account credentials. We are not liable for any loss or damage arising from your failure to protect your account information.

Acceptable use

You agree to use our services only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use our services to violate any applicable laws or regulations
  • Infringe upon the intellectual property rights of others
  • Upload, transmit, or distribute any harmful, offensive, or illegal content
  • Attempt to gain unauthorised access to our systems or other users’ accounts
  • Use our services to harass, abuse, or harm others
  • Interfere with or disrupt the operation of our services
  • Use automated systems or bots to access our services without permission
  • Reverse engineer, decompile, or disassemble any part of our services

We reserve the right to suspend or terminate your account if you violate these Terms or engage in any activity that we determine is harmful to our services or other users.

User content

You retain ownership of any content, annotations, projects, and data that you create or upload using our services ("User content"). Your User content includes projects, annotations (Issues, Strengths, Bugs), screenshots, attachments, and any other content you create or upload using our services. By using our services, you grant us a limited licence to:

  • Store, process, and transmit your User content to provide our services
  • Back up your User content for data recovery purposes
  • Display your User content within our services
  • Make your User content accessible via shareable links when you choose to share a project

You are solely responsible for your User content. We do not claim ownership of your User content and will not use it for purposes other than providing our services, except as required by law or as described in our privacy policy.

When you share a project via a shareable link, you are responsible for ensuring that the content is appropriate for sharing and that you have the right to share it. Recipients with access to shared links have full interactive access to your annotations, including the ability to filter, sort, select which annotations to include in exports, and export in multiple formats. Do not share links publicly if you wish to keep your annotations private.

Intellectual property

All content, features, and functionality of our services, including but not limited to text, graphics, logos, icons, images, software, and code, are owned by Design Owls or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our services without our express written permission.

Payment and subscriptions

Freebird is currently available free of charge. We reserve the right to introduce paid features or subscriptions in the future with 30 days’ notice. If we introduce paid subscriptions:

  • You agree to pay all fees associated with your subscription
  • Subscription fees are charged in advance on a recurring basis
  • We reserve the right to change our pricing with 30 days’ notice
  • All fees are non-refundable except as required by law or as explicitly stated in our refund policy
  • You may cancel your subscription at any time, and cancellation will take effect at the end of your current billing period

Free trial periods, if offered, will be clearly disclosed, and you may be charged automatically at the end of the trial period unless you cancel.

Termination

You may terminate your account at any time by deleting it through your account settings. We reserve the right to suspend or terminate your account immediately if you:

  • Violate these Terms or our privacy policy
  • Engage in fraudulent or illegal activity
  • Fail to pay any fees due
  • Use our services in a manner that harms us or other users

Upon termination, your right to use our services will immediately cease. We may delete your account and User content in accordance with our privacy policy. Provisions of these Terms that by their nature should survive termination will survive.

Disclaimers

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted, secure, or error-free, or that any defects will be corrected. We are not responsible for the accuracy, completeness, or usefulness of any information provided through our services.

Smart Fill provides suggestions based on local rule-based analysis. These suggestions are provided "as is" and you are responsible for reviewing and validating any automated suggestions before using them in your annotations.

Limitation of liability

To the maximum extent permitted by law, Design Owls and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of our services.

Indemnification

You agree to indemnify, defend, and hold harmless Design Owls and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of our services, your User content, or your violation of these Terms.

Changes to these terms

We may update these Terms from time to time to reflect changes in our practices or applicable laws. We will notify you of any material changes by posting the new Terms on this page and updating the "Effective date" below. Your continued use of our services after such changes constitutes acceptance of the new Terms.

Governing law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Design Owls operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
